1. GENERAL PROVISIONS
These conditions are valid exclusively between the company Antonelli Maglieria di Doardo Paola e C. SAS, hereinafter referred to as ANTONELLI MAGLIERIA, and any subject making online purchases, hereinafter referred to as CUSTOMER, by connecting to the link www.antonellimaglieria.com, hereinafter referred to as SITE, corresponding to the e-commerce site. For communications between the parties, the email address store@antonellimaglieria.com is provided, hereinafter referred to as EMAIL. The conditions may be subject to changes; the date of online publication corresponds to the date of entry into force.
2. SUBJECT OF THE CONTRACT
2.1 With these General Terms and Conditions of Sale, ANTONELLI MAGLIERIA sells and the CUSTOMER purchases remotely the products indicated and offered for sale on the SITE.
2.2 The contract is concluded exclusively through the internet, by the CUSTOMER accessing the SITE and placing a purchase order according to the procedure provided by the SITE itself.
3. CONCLUSION AND EFFECTIVENESS OF THE CONTRACT
3.1 The sale will be considered concluded with the sending by ANTONELLI MAGLIERIA to the CUSTOMER of an order confirmation email. The email will contain the details of the CUSTOMER and the order, the price of the purchased goods, the shipping costs, and the shipping address to which the goods will be sent. The CUSTOMER undertakes to verify the correctness of the data contained therein and to promptly communicate any corrections.
3.2 ANTONELLI MAGLIERIA undertakes to describe and present the items sold on the SITE in the best possible way. Nevertheless, some errors, inaccuracies, or small differences between the SITE and the actual product may occur. Furthermore, the product photographs presented on the SITE do not constitute a contractual element, as they are only representative.
3.3 ANTONELLI MAGLIERIA undertakes to deliver the goods within 15 days from the sending of the order confirmation email to the CUSTOMER.
4. PRODUCT AVAILABILITY
4.1 The availability of the products refers to what is present at the time the CUSTOMER consults the product sheets; this must in any case be considered purely indicative because, due to the simultaneous presence of several users on the SITE, the products could be sold to others before the order is confirmed.
4.2 Even after the sending of the order confirmation email by ANTONELLI MAGLIERIA, cases of partial or total unavailability of the goods may occur. In this event, the CUSTOMER will be promptly informed and may decide whether to accept delivery of only the available products or request the cancellation of the order by communicating it via email.
5. PAYMENT METHODS
5.1 Every payment by the CUSTOMER may only be made through one of the methods indicated on the SITE. For payments made via Paypal, if the unavailability of a product is detected after the order has been registered, ANTONELLI MAGLIERIA will take the necessary measures with the payment operator to reverse the transaction relating to the unavailable goods.
5.2 Communications relating to payment and the data communicated by the CUSTOMER at the time it is made take place through secure and protected protocols provided by the payment circuits.
6. PRICES
6.1 All sales prices of the products displayed and indicated on the SITE are expressed in Euros and include VAT.
6.2 Shipping costs are not included in the purchase price, but are indicated and calculated at the conclusion of the purchase process before payment is made.
6.3 The CUSTOMER accepts the right of ANTONELLI MAGLIERIA to change its prices at any time, however the goods will be invoiced based on the prices indicated on the SITE at the time of the order and confirmed in the email sent by ANTONELLI MAGLIERIA as confirmation of the order acquisition.
7. RIGHT OF WITHDRAWAL
7.1 In accordance with current legal provisions, the CUSTOMER has the right to withdraw from the purchase without any penalty and without specifying the reason, within a period set by ANTONELLI MAGLIERIA at 14 days as provided by law, starting from the date of delivery of the products. By law, the shipping costs for returning the goods are borne by the CUSTOMER. The goods must be returned intact, in the original packaging, complete in all its parts and with any tax documentation required by law.
Without prejudice to the right to verify compliance with the above, ANTONELLI MAGLIERIA will refund the amount of the products subject to withdrawal as soon as possible and in any case within a maximum period of 30 days.
7.2 In case of receipt of products not conforming to the orders or defective, the CUSTOMER may notify this via email within 7 days from the date of receipt of the goods. In the email it will be necessary to specify whether you wish to replace the item or obtain a refund. Replacement can only take place with the same model and color, but of a different size from the returned item(s). ANTONELLI MAGLIERIA will contact the courier who, subject to availability, will collect the goods. ANTONELLI MAGLIERIA reserves the right to verify the reported non-conformity and, if confirmed, will proceed with the shipment of the replacement goods or the refund by crediting the card used by the CUSTOMER for the purchase.
8. DELIVERY METHODS
8.1 ANTONELLI MAGLIERIA will only accept orders to be delivered within the Italian territory and in the countries belonging to the European Union at the date of acceptance of the order. The products will be delivered by express courier to the address indicated by the CUSTOMER at the time of the order.
8.2 For each order placed on the SITE, ANTONELLI MAGLIERIA issues an invoice for the shipped material, sending it via email after the order has been processed. For the issuance of the invoice, the information provided by the CUSTOMER during the purchase procedure is valid. After the invoice has been issued, it will not be possible to make any changes to the data indicated therein.
9. LIABILITY
9.1 ANTONELLI MAGLIERIA assumes no responsibility for disruptions due to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disruptions of the internet network, in the event that it is unable to execute the order within the times provided by the contract.
9.2 The availability of each item is for indicative purposes only, is not contractual, and no liability can be attributed to ANTONELLI MAGLIERIA in case of unavailability of one or more products.
10. ACCESS TO THE SITE
The CUSTOMER has the right to access the SITE for consultation and making purchases. No other use, especially commercial, of the SITE or its content is permitted. The integrity of the elements of this SITE, whether sound or visual, and the related technology used remain the property of ANTONELLI MAGLIERIA and are protected by intellectual property rights.
11. COOKIES
The SITE uses “cookies”, electronic files that record information relating to the CUSTOMER's navigation on the SITE (pages viewed, date and time of viewing...) and that allow ANTONELLI MAGLIERIA to offer an increasingly personalized service to its customers.
12. APPLICABLE LAW AND JURISDICTION
These General Terms and Conditions of Sale are subject to Italian law. For any dispute concerning the validity, execution, or interpretation of the Contract and its related effects, the Court of Verona will have jurisdiction.
